What’s Different About Texas Right Now

Texas decides injury cases by handing out fault as a percentage to everyone involved. Two things follow from that: what your own percentage does to a recovery, and the exact point where the recovery stops existing.

  • Texas runs on proportionate responsibility under Tex. Civ. Prac. & Rem. Code §33.001. Every party who contributed to causing the injury gets a percentage of the fault.
  • Proportionate is the operative word. A claimant’s own percentage generally comes off what they recover: 10% at fault, 90% recovered. 40% at fault, 60%.
  • The bar sits above 50%. More than half the fault and the recovery is zero, no matter how serious the injury was or how many other parties are splitting the rest.
  • Read literally, that leaves exactly 50% on the recovering side in Texas — the same threshold Louisiana and Florida use. The number that actually varies state to state isn’t the cutoff, it’s what happens below it.
  • One thing this page doesn’t cover: the Texas filing deadline for an injury claim. We didn’t source it, so we’re not putting a number on it. A wrong deadline on a website is worse than no deadline at all.

Texas attorney advertising runs on more than the ABA baseline, and none of it is a surprise if you plan for it. If the site offers contingent-fee representation, the State Bar wants that ad to say whether the client is on the hook for costs beyond the fee.
